Adventures24 GmbH - General Terms and Conditions

Corporate Purpose
Adventures24 GmbH (abbreviated as AD24) presents balloon offers in a clear manner under the protected name Balloon Adventures (abbreviated as BA) and makes a pre-selection for its customers. AD24 acts as an intermediary for leisure activities but does not perform the services itself. The services are carried out on their own account by various partners of AD24 (also referred to as service partners), who are solely responsible for conducting the adventures/experiences. The terms and conditions of the service partners apply to the execution.
A contract between AD24 and the customer is only concluded for the mediation service, for which the following general terms and conditions apply, in the version valid at the time of the order. The contract regarding the booking and execution of the respective adventure is made directly between the customer and the respective organizer. Therefore, the fulfillment of the booked service is not part of AD24's obligation to perform.
Vouchers
Customers either purchase a voucher for a specific type of adventure (adventure voucher) or a general voucher issued for a certain amount (PrePaid voucher). The vouchers must be activated online for a specific adventure/experience so that the voucher can be redeemed with the partner. After activation, the customer and the service partner receive each other's contact details and can set a date for the adventure. The voucher must be handed over to the organizer.
Adventure vouchers can be exchanged for a PrePaid voucher. Thus, it is possible to decide on a different adventure until activation.
If the value of the chosen adventure is higher than the amount of the PrePaid voucher, the difference must be paid. Conversely, if the value of the chosen adventure is lower than the amount of the PrePaid voucher, a remaining balance is kept on the voucher. The remaining balance can be checked online using the voucher number.
The voucher can be redeemed within 3 years from the date of issue. After this period, the voucher can be extended once for another year against a processing fee of €20.00.
The voucher is transferable, but it is important to ensure that the person meets the participation requirements of the adventure.
Some adventures/experiences depend on a minimum number of participants; if this number is not met, the experience will not take place. In this case, the vouchers retain their validity and a new date will be announced.
The vouchers cannot be redeemed for cash.
Tickets
Unlike a voucher, with a ticket, the organizer and the event date are already fixed at the time of purchase. The ticket does not need to be activated, and the organizer's contact details are already on the ticket. A right of withdrawal and exchange similar to the adventure vouchers is excluded.
If the adventure cannot be conducted due to force majeure, especially due to bad weather conditions, the ticket can be redeemed like an adventure voucher on another day. The decision on whether bad weather conditions exist that lead to the cancellation of the event lies exclusively with the organizer. Compensation for any travel or accommodation costs incurred will not be provided. Unilateral withdrawal from the event contract is excluded, unless there are important, statutory reasons. If the booker or participant and the organizer agree to cancel the event contract, the mediation by AD24 can be reversed. In this case, the booker or participant receives the ticket value in the form of a Balloon Adventures voucher. Cash payment is not possible.
Prices
All prices stated are final prices and include statutory VAT. In addition to the named prices, costs for mediation, packaging, and shipping may apply, but these will be itemized separately.
The price guarantee of BA refers to the regular sales price of the service partners. Promotions or discounts for certain groups of people are excluded from the price guarantee.
Discount and Advantage Codes
Discount or advantage codes cannot be combined with other discount promotions. Only one discount code can be redeemed per order. Discount codes have a limited validity and a minimum order value. For PrePaid vouchers created by exchanging adventure vouchers, the subsequent application of discount codes is not possible. An application during an exchange into a PrePaid voucher is not possible. Cash payment as well as subsequent application to already placed orders is excluded.
Payment Terms
The ordered vouchers can be paid by invoice (transfer), credit card, or PayPal. When paying by invoice, the amount must be paid within one week of receiving the invoice; in this case, the vouchers are only activated after full payment has been received by AD24. When paying by credit card, the voucher can be activated immediately.
Delivery
The delivery of the voucher wrapped as a gift occurs within 3-7 business days to the address provided at the time of ordering. The PDF version for last-minute givers is of course available free of shipping costs within a few minutes.
Right of Withdrawal
Consumers have the right to revoke their order within 14 days of receiving the vouchers without stating reasons, either in writing (letter, email) or by returning the originally packaged voucher with complete and unused contents.
To adhere to
the withdrawal period, the timely dispatch of the revocation or the goods is sufficient.
Consequences of Withdrawal:
The customer must bear the costs of returning the goods if the price of the goods to be returned does not exceed €40.00, or if at a higher price of the goods the customer has not yet provided the consideration or a partial payment at the time of revocation, unless the delivered goods do not match the ordered goods. The refund will be made by transfer to an account specified by the customer. For all customers who activate their adventure/experiences within the 14 days, the 14-day right of withdrawal expires prematurely, as they automatically agree to an early end of the right of withdrawal.

Physical Requirements of Participants
Participation in certain experiences requires a minimum level of personal suitability (e.g., height, age, health condition, weight). These requirements are specified in the individual adventure descriptions. After activation, the purchaser of a voucher is responsible for ensuring that the respective person who will participate in the experience meets the minimum requirements. A refund of the purchase price is excluded if the minimum requirements are not met.
Right of Withdrawal of the Organizer (Service Partner)
A right of withdrawal also exists if the experience cannot be conducted due to force majeure, especially due to bad weather conditions. The decision on whether bad weather conditions exist that lead to the cancellation of the event lies exclusively with the organizer. Participants are required to consult with the organizer in a timely manner, with the latest possible time and the necessary contact information provided in the booking confirmation. In the event of withdrawal by the organizer, the participant has the right to rebook free of charge. Compensation for any travel or accommodation costs incurred will not be provided.
Right of Withdrawal of AD24
Until an experience is activated by the voucher holder, AD24 is entitled to withdraw from the contract for an important reason. An important reason includes:
the organizer is no longer a service partner of AD24 in the meantime or has generally ceased business operations
it is economically unreasonable for the organizer to conduct the experience
force majeure
If one of these cases occurs, AD24 will inform you immediately.
In the event of withdrawal from the contract for an important reason, you will receive the booking price paid to us immediately. You also have the option to book an equivalent adventure from the BA offer. Further claims against AD24, especially claims for damages (e.g., travel expenses, accommodation), are excluded.
Changes to the Offer
AD24 reserves the right to make changes to the organizer or the adventure. In the case of a significant change in the contents of an adventure, the customer is entitled to withdraw from the contract free of charge or to choose an equivalent adventure from the BA offer.
Liability of AD24
Information about mediated adventures/experiences is based exclusively on the information provided by the organizers and is not a guarantee by BA to the customer.
AD24 is not liable for the performance of the mediated adventures/experiences by the organizer, but only for the careful selection of the respective organizer, the proper mediation of the experience, and the proper and verifiable transmission of information, advertisements, declarations of intent, and payments between customers and organizers.
For damages resulting from the breach of contractual obligations, AD24 is liable without limitation up to the price of the mediated experience. For damages beyond this, AD24 is only liable in cases of intent or gross negligence.
AD24 assumes no liability for the unlawful redemption of vouchers. In the event of loss or theft of vouchers or tickets, the customer is therefore required to contact AD24 immediately so that a code lock can be initiated.
Retention of Title / Withdrawal in Case of Non-payment / Consequences of Delay in Payment
Until full payment is made, the voucher remains the property of AD24. Payment must be made no later than one week after the invoice date (date of invoice). After the expiration of this payment period, AD24 has the right to withdraw from the contract at any time or to cancel the voucher, resulting bookings, or credits. Legal claims regarding the consequences of late payment remain unaffected. The redemption of the voucher is only under the condition that the purchase price for the voucher has been fully settled with AD24.
Other Provisions
The invalidity of individual provisions of the mediation contract or the GTC does not affect the validity of the entire contract.
The court of jurisdiction for all legal disputes arising from a contract with business customers is agreed to be the competent court in Ried im Innkreis.
All image and text material may only be used with the consent of AD24.
